These Terms of Service govern access to sparkiogoods.com and purchases from SPARKIO LLC, operating as SPARKIO GOODS. By using the website or placing an order, the customer agrees to these Terms and the policies incorporated by reference.

Orders and Acceptance

An order confirmation acknowledges receipt but does not necessarily constitute final acceptance. We may decline, limit, or cancel an order for suspected fraud, payment failure, inventory error, pricing error, shipping restriction, resale activity, or inaccurate customer information. If we cancel a paid order, we will refund the affected amount.

Prices are stated in U.S. dollars unless otherwise shown. Applicable taxes are calculated at checkout. Customers must provide accurate and authorized billing information. Obvious pricing or description errors may be corrected, and an affected order may be canceled and refunded.

The customer grants SPARKIO LLC a nonexclusive, worldwide, royalty-free license to use, reproduce, display, and adapt the submitted content for operating and promoting the store, subject to applicable privacy law. We may remove unlawful, deceptive, abusive, or irrelevant content.

Disclaimer and Limitation of Liability

To the extent permitted by law, the website and services are provided on an as-available basis. We do not guarantee uninterrupted or error-free operation. Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded.

To the maximum extent permitted by law, SPARKIO LLC is not liable for indirect, incidental, special, punitive, or consequential damages. For a claim relating to a purchase, our aggregate liability will not exceed the amount paid for the product giving rise to the claim, unless applicable law requires otherwise.

Governing Law and Severability

These Terms are governed by the laws of the State of Missouri and applicable federal law, without depriving a consumer of mandatory rights available under the law of the consumer’s residence. If any provision is unenforceable, the remaining provisions continue in effect.
